Public Health Laboratory Service Act 1979

An Act to extend the powers conferred by section 5(2)(c) of the National Health Service Act 1977 and to amend certain provisions of that Act relating to the Public Health Laboratory Service Board.

1 Extension of public health laboratory service. C1

In section 5 of the National Health Service Act 1977 M1 (miscellaneous services) in paragraph (c) of subsection (2) (provision of a microbiological service for the control of the spread of infectious diseases) for the words following “diseases” there shall be substituted “ and carry on such other activities as in his opinion can conveniently be carried on in conjunction with that service ”.

After that subsection there shall be inserted—

Charges may be made for services or materials supplied by virtue of paragraph (c) of subsection (2) above; and the powers conferred by that paragraph may be exercised both for the purposes of the health service and for other purposes.

In subsection (4) of that section (functions of Public Health Laboratory Service Board) for the words from “administration” to the end there shall be substituted “ powers conferred by paragraph (c) of subsection (2) above as the Secretary of State may determine ”.

In Schedule 3 to that Act (constitution etc. of Public Health Laboratory Service Board) in paragraph 2 for the words from “the public” to the end there shall be substituted “ its functions ”.

2 Payments in respect of membership of Public Health Laboratory Service Board and its committiees. C2

In paragraph 12 of Schedule 3 to that Act (payment of travelling and other allowances) for the words from “travelling” to the end there shall be substituted “ renumeration and allowances, and may make such provision for the payment of pensions, gratuities or allowances to or in respect of persons who have ceased to be members of the Board, as the Secretary of State may with the approval of the Minister for the Civil Service determine ”.

3 Short title and extent.

This Act may be cited as the Public Health Laboratory Service Act 1979.

This Act does not extend to Scotland or Northern Ireland.
