SCHEDULE 2Amendment of Enactments

The [1868 c. 64.] Land Registers (Scotland) Act 1868

1In section 6 of the Land Registers (Scotland) Act 1868 (recording in Register of Sasines of writs transmitted by post) for "day, and hour " substitute " and day ".

The [1868 c. 101.] Titles to Land Consolidation (Scotland) Act 1868

2In section 142 of the Titles to Land Consolidation (Scotland) Act 1868, for the words "day, and hour" substitute " and day ", and for " at the same time " substitute " on the same day ".

The [1938 c. 24.] Conveyancing Amendment (Scotland) Act 1938

3In section 6 of the Conveyancing Amendment (Scotland) Act 1938 (provisions as to actions of declarator of irritancy)—

(a)in subsection (1), after "action", where thirdly occurring, insert " or from an examination of the relevant title sheet in the Land Register of Scotland ".

(b)in subsection (2) after " search " insert " or examination ".

The [1970 c. 35.] Conveyancing and Feudal Reform (Scotland) Act 1970

4In section 28 of the Conveyancing and Feudal Reform (Scotland) Act 1970 (foreclosure)—

(a)in subsection (3) at the end insert " or by an examination of the title sheet of the security subjects in the Land Register of Scotland. ";

(b)in subsection (5) after the words " unsold part thereof " where secondly occurring insert " or in accordance with section 15 of the Land Registration (Scotland) Act 1979 ".

The [1974 c. 45.] Housing (Scotland) Act 1974

5In section 9 of the Housing (Scotland) Act 1974 (conditions of improvement grants), in subsection (9)—

(a)in paragraph (i), after " tenant-at-will" insert " or was a tenant-at-will who, since applying, has acquired his landlord's interest in the tenancy ";

(b)in paragraph (ii), after " was" insert " , and continues to be, ".

6In paragraph 7 of Schedule 2 to the said Act of 1974 (consequences of breach of conditions under section 9)—

(a)in sub-paragraph (a), after " tenant-at-will" insert " or was a tenant-at-will who, since applying, has acquired his landlord's interest in the tenancy, ";

(b)in sub-paragraph (b), after " was " insert " , and continues to be, ".
