Transfer of ownership and guardianship of ancient monumentsE+W+S

21 Transfer of ancient monuments between local authorities and Secretary of State.E+W+S

(1)Subject to subsection (2) below, the Secretary of State [F1and the Commission] and any local authority may, in respect of any monument of which they are the owners or guardians by virtue of this Act or any land associated with any such monument, enter into and carry into effect any agreements for the transfer—

(a)from the Secretary of State to the local authority;

(b)from the local authority to the Secretary of State; or

(c)from the local authority to another local authority; [F2or

(d)from the Secretary of State to the Commission; or

(e)from the Commission to the Secretary of State; or

(f)from the Commission to the local authority; or

(g)from the local authority to the Commission;]

of that monument or land or (as the case may be) of the guardianship of that monument or land.

(2)Where the Secretary of State [F3or the Commission] or the local authority in question are guardians of a monument or associated land, they may not enter into an agreement under this section with respect to that monument or land without the consent of the persons who are for the time being immediately affected by the operation of the guardianship deed.

[F4(3)The Commission may not enter into an agreement under subsection (1) above in respect of a monument or land not situated in England.

(4)The Secretary of State may not enter into an agreement mentioned in subsection (1)(a) or (b) above in respect of a monument or land situated in England without consulting the Commission.

(5)The Commission may not enter into an agreement mentioned in subsection (1)(f) above without consulting the Secretary of State.

(6)The Commission may not enter into an agreement mentioned in subsection (1)(g) above without the consent of the Secretary of State.]
