Establishment, discontinuance and eration of schools

C114 Approval of school premises.

Where proposals submitted under section 12 or 13 above are for—

a

the establishment of a school;

b

the maintenance of a school as a county or voluntary school; or

c

the making of a significant change in the character, or significant enlargement of the premises, of a school F1or the transfer of a school to a new site,

the persons making the proposals shall, at such time and in such form and manner as the Secretary of State may direct, submit to him for his approval such particulars with respect to the premises or proposed premises of the school as he may require.

Before submitting any particulars under this section in respect of a school which is or is to be maintained as a voluntary school, the governors or the persons by whom the school is to be established shall consult the local education authority.

Where particulars with respect to any school are required to be submitted under this section, the persons whose duty it is under section 12 or 13 above to implement the proposals shall implement them in accordance with the particulars as approved by the Secretary of State.

In F3 section 63(2) of the M1Education Act 1944 (exemption from building regulations etc.) references to plans approved by the Secretary of State shall include references to any particulars submitted to and approved by him under this section.]
