Section 141.

SCHEDULE 27Vesting of Land in Urban Development Corporations

PART IModification of Enactments : England and Wales

1Paragraphs 6 to 14 and 16 of Schedule 3 to the [1968 c. 72.] Town and Country planning Act 1968 shall have effect, in relation to orders under section 141 above, subject to the modifications specified in paragraphs 2 to 4 below.

2Any reference to a general vesting declaration shall be treated as a reference to an order under that section.

3The references in paragraphs 6 and 7 to the end of the period specified in a general vesting declaration shall be treated as references to the date on which such an order comes into force and the reference in paragraph 10 to the acquiring authority having made a general vesting declaration shall be treated as a reference to such an order having come into force.

4In paragraph 6—

(a)the reference to every person on whom, under section 5 of the [1965 c. 56.] Compulsory Purchase Act 1965, the acquiring authority could have served a notice to treat, shall be treated as a reference to every person whose interest in the land to which such an order relates is vested by the order in the urban development corporation; and

(b)paragraph (a) shall be omitted.

5Schedule 3A to that Act shall have effect, in relation to orders under section 141 above subject to the modifications specified in paragraphs 6 to 8 below.

6Any reference to a general vesting declaration shall be treated as a reference to an order under that section.

7The reference in paragraph 4(2) to the date on which the notice required by paragraph 4 of Schedule 3 is served on any person shall be treated as a reference to the date on which such an order comes into force.

8In paragraph 12—

(a)sub-paragraph (1) (a) shall be omitted ; and

(b)the reference in sub-paragraph (1)(6) to the date on which a person first had knowledge of the execution of the general vesting declaration shall be treated as a reference to the date on which an order under section 141 above came into force.

9The [1961 c. 33.] Land Compensation Act 1961 shall have effect in relation to orders under section 141 above subject to the modifications specified in paragraphs 10 to 14 below.

10References to the date of service of a notice to treat shall be treated as references to the date on which an order under that section comes into force.

11Section 17(2) shall be treated as if for the words "the authority proposing to acquire it have served a notice to treat in respect thereof, or an agreement has been made for the sale thereof to that authority" there were substituted the words " an order under section 141 of the Local Government, Planning and Land Act 1980 vesting the land in which the interest subsists in an urban development corporation has come into force, or an agreement has been made for the sale of the interest to such a corporation ".

12In section 22—

(a)subsection (2) shall be treated as if at the end of paragraph (c) there were added the words or

(d)where an order has been made under section 141 of the Local Government, Planning and Land Act 1980 vesting the land in which the interest subsists in an urban development corporation.; and

(b)subsection (3) shall be treated as if in paragraph (a) the words " or (d) " were inserted after the words " paragraph (b) ".

13Any reference to a notice to treat in section 39(2) shall be treated as a reference to an order under section 141 above.

14In Schedule 2, paragraph 2(2)(a) shall be treated as if the words " or the coming into force of an order under section 141 of the Local Government, Planning and Land Act 1980 for the vesting of the land in an urban development corporation " were inserted after the word " land ".

PART IIModification of Enactments : Scotland

15Paragraphs 6 to 13 and 16 to 39 of Schedule 24 to the Town and Country Planning (Scotland) Act 1972 shall have effect in relation to orders under section 141 above, subject to the modifications specified in paragraphs 16 to 20 below.

16Any reference to a general vesting declaration shall be treated as a reference to an order under that section.

17The references in paragraphs 6 and 7 to the end of the period specified in a general vesting declaration shall be treated as references to the date on which such an order comes into force and the reference in paragraph 9 to the acquiring authority having made a general vesting declaration shall be treated as a reference to such an order having come into force.

18In paragraph 6—

(a)the reference to every person on whom, under section 17 of the [1845 c. 19.] Lands Clauses Consolidation (Scotland) Act 1845, the acquiring authority could have served a notice to treat, shall be treated as a reference to every person whose interest in the land to which such an order relates is vested by the order in the urban development corporation ; and

(b)paragraph (a) shall be omitted.

19The reference in paragraph 20(2) to the date on which the notice required by paragraph 4 is served on any person shall be treated as a reference to the date on which such an order comes into force.

20In paragraph 29—

(a)sub-paragraph (1)(a) shall be omitted ; and

(b)the reference in sub-paragraph (1)(b) to the date on which a person first had knowledge of the execution of the general vesting declaration shall be treated as a reference to the date on which an order under section 141 above came into force.

21The [1963 c. 51.] Land Compensation (Scotland) Act 1963 shall have effect in relation to orders under section 141 above subject to the modifications specified in paragraphs 22 to 26 below.

22References to the date of service of a notice to treat shall be treated as references to the date on which an order under that section comes into force.

23Section 25(2) shall be treated as if for the words "the authority proposing to acquire it have served a notice to treat in respect thereof, or an agreement has been made for the sale thereof to that authority" there were substituted the words " an order under section 141 of the Local Government, Planning and Land Act 1980 vesting the land in which the interest subsists in an urban development corporation has come into force, or an agreement has been made for the sale of the interest to such a corporation. "

24In section 30—

(a)subsection (2) shall be treated as if at the end of paragraph (c) there were added the words or

(d)where an order has been made under section 141 of the Local Government, Planning and Land Act 1980 vesting the land in which the interest subsists in an urban development corporation.; and

(b)subsection (3) shall be treated as if in paragraph (a) the words " or (2)(d) " were inserted after the words " subsection (2)(b) ".

25Any reference to a notice to treat in section 45(2) shall be treated as a reference to an order under section 141 above.

26In Schedule 2, paragraph 1(2)(a) shall be treated as if the words " or the coming into force of an order under section 141 of the Local Government, Planning and Land Act 1980 for the vesting of the land in an urban development corporation" were inserted after the word " land ".
