61 Regulations supplementing maintenance powers of district councils.E+W
The Minister may by regulations empower [non-metropolitan] district councils, in relation to highways in respect of which their powers of maintenance under sections 42 and 50 above are exercisable, to exercise subject to such terms and conditions as may be specified in the regulations such additional powers as appear to him—
(a)to be appropriate to supplement powers of maintenance; and
(b)to correspond to powers exercisable in relation to highways by highway authorities;
and accordingly in those sections, in Schedule 7 to this Act and in any other enactment referring to the powers of [non-metropolitan] district councils under those sections, the expressions “maintenance” and “maintain” where used with respect to the powers of [non-metropolitan] district councils under those sections, are to be construed as including the carrying out of operations in the exercise of powers conferred on [non-metropolitan] district councils by regulations under this section.
