259Power to confirm, etc., compulsory purchase order in part and postpone consideration of remainder

(1)Where in the exercise of highway land acquisition powers a compulsory purchase order authorising the acquisition of any land is submitted to the Minister in accordance with Part I of Schedule 1 to the Act of 1946 or is prepared in draft by him in accordance with Part II of that Schedule, then, if the Minister—

(a)is satisfied that the order ought to be confirmed or made so far as it relates to a part of the land comprised therein, but

(b)has not for the time being determined whether it ought to be confirmed or made so far as it relates to the remaining part,

he may confirm or, as the case may be, make the order so far as it relates to the part of the land mentioned in paragraph (a) above, and give directions postponing consideration of the order, so far as it relates to the remaining part, until such time as may be specified by or under the directions; and where the Minister confirms or makes part of any such order, that part and the remaining part are each to be deemed for the purposes of this section and the said Schedule 1 to be a separate order.

(2)Where the Minister gives directions under this section, the notices required by paragraph 6 of the said Schedule 1, or by that paragraph as applied by paragraph 7C of that Schedule, to be published and served shall include a statement of the effect of the directions.
