(1)Subject to subsection (2) below, [F1sections 238 to 240 of the Town and Country Planning Act 1990] and section 118 of the M1Town and Country Planning (Scotland) Act 1972 (consecrated land and burial grounds) shall have effect in relation—
(a)to land acquired by the Secretary of State for purposes connected with the exercise of his functions relating to civil aviation, and
(b)to land acquired by the Secretary of State in pursuance of this Part of this Act and otherwise than as mentioned in paragraph (a) above,
as if the Secretary of State had acquired that land under [F1Part IX of the said Act of 1990] or, as the case may be, Part VI of the said Act of 1972.
(2)[F2The said sections 238 to 240] and 118 shall have effect in relation to any land acquired by the CAA as they have effect in relation to land acquired by statutory undertakers under [F2Part IX of the said Act of 1990] or, as the case may be, Part VI of the said Act of 1972.
