The following subsection shall be inserted after section 7(3) of the 1977 Act :—

“(3A)

Liability for breach of obligations arising under section 2 of the Supply of Goods and Services Act 1982 (implied terms about title etc. in certain contracts for the transfer of the property in goods) cannot be excluded or restricted by reference to any such term.”

In consequence of subsection (2) above, in section 7(4) of the 1977 Act, after “cannot” there shall be inserted “ (in a case to which subsection (3A) does not apply) ”.
