Procedure on all election petitions
F1151 Report on withdrawal.
(1)
In every case of the withdrawal—
(a)
of a parliamentary election petition, the court giving leave for the withdrawal shall make a report to the Speaker as required by subsection (2) below; and
(b)
by leave of the election court, of a petition questioning an election in England and Wales under the local government Act, that court shall make a report in writing to the High Court as so required.
(2)
The report shall state whether in the court’s opinion the withdrawal of the petition was—
(a)
the result of any agreement, terms or undertaking, or
(b)
in consideration of any payment, or in consideration that the seat or office should at any time be vacated or in consideration of the withdrawal of any other election petition or for any other consideration,
and, if so, shall state the circumstances attending the withdrawal.
