62Offences as to declarations

1

A person who—

a

makes a patient's declaration or a service declaration—

i

when he is not authorised so to do by section 7(4) or section 15(1) above, as the case may be, or

ii

except as permitted by this Act, when he knows that he is subject to a legal incapacity to vote, or

iii

when he knows that it contains a statement which is false, or

b

attests a patient's declaration or a service declaration, as the case may be, when he knows—

i

that he is not authorised to do so, or

ii

that it contains a false statement as to any particulars required by paragraph (d) of section 7(4), or by regulations under section 15, as the case may be,

shall be liable—

  • except in Northern Ireland, on summary conviction to imprisonment for a term not exceeding 6 months or to a fine not exceeding level 4 on the standard scale or to both;

  • in Northern Ireland, on summary conviction to imprisonment for a term not exceeding 3 months or to a fine not exceeding £50 or to both, or on conviction on indictment to imprisonment for a term not exceeding 6 months or to a fine not exceeding £100 or to both.

Where the declaration is available only for local government elections the reference in subsection (1) above to a legal incapacity to vote refers to a legal incapacity to vote at local government elections.
