In section 39 of the 1979 Act (power of investigating authority to investigate in advance of operations notice any site which may be acquired compulsorily) after paragraph (c) of subsection (4) there shall be inserted
and

where the site in question is situated in England, the Commission (if the investigating authority is not the Commission);
