1(1)In this Schedule and in any enactment amended by this Schedule—E+W+S
“the operator” means—
in relation to a telecommunications code system the running of which is authorised by a licence under section 7 of this Act, the person to whom the telecommunications code is applied by that licence; and
in relation to a telecommunications code system which the Secretary of State or a Northern Ireland department is running or proposing to run, the Secretary of State or, as the case may be, that department;
“public telecommunications operator” has the meaning given by section 9(3) of this Act;
“telecommunication apparatus” has the same meaning as in Schedule 2 to this Act;
“telecommunication system” has the meaning given by subsection (1) of section 4 above (read with subsection (2) of that section);
“the telecommunications code” means the code contained in Schedule 2 to this Act;
“telecommunications code system” means—
a telecommunications system the running of which is authorised by a licence under section 7 of this Act applying the telecommunications code to any person; or
a telecommunication system which the Secretary of State or a Northern Ireland department is running or proposing to run and in relation to which the telecommunications code has effect by virtue of section 10(1)(b) of this Act.
(2)Subsection (11) of section 7 of this Act shall apply for the purposes of this Schedule and any enactment amended by this Schedule as it applies for the purposes of that section and the following provisions of Part II of this Act.
