SCHEDULE 9 Minor and Consequential Amendments
The Fire Services Act 1947 (c. 41)

The Fire Services Act 1947 shall be amended in accordance with this paragraph.

In section 3 (supplementary powers of fire authorities)—
a
in subsection (1)(c), for the word “street”, in both places where it occurs, there shall be substituted the word “road”; and
b
in subsection (2), for the words from “trunk road” to the end of paragraph (a) there shall be substituted the words
public road a fire authority shall (where they are not themselves the roads authority) obtain the consent of the roads authority; and—
a
without prejudice to the foregoing provisions of this subsection, the said powers shall not be exercised in a district except after consultation with the council of the district,

In section 14(3)(a) (marking of positions of fire hydrants), for the word “street” there shall be substituted the word “road”.

In section 30(5) (powers of firemen and police in extinguishing fires), for the word “street”, in both places where it occurs, there shall be substituted the word “road”.

In section 38(1) (interpretation), for the definition of “street” there shall be substituted the following definitions—
“road” has the same meaning as in the Public Utilities Street Works Act 1950; and
“roads authority” has the same meaning as in the Roads (Scotland) Act 1984;
