Hill Farming Act 1985

1985 CHAPTER 32

An Act to extend provision made in section 20 of the Hill Farming Act 1946 for regulating or prohibiting the burning of heather and grass so as to include bracken, gorse and vaccinium.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1 Burning of bracken, gorse and vaccinium.U.K.

The power under section 20 of the M1Hill Farming Act 1946 to make regulations with respect to the burning of heather and grass in England and Wales shall apply also to the burning of bracken, gorse and vaccinium; and accordingly, for the words “and grass”—

(a)in both places where they occur in subsection (1) of that section; and

(b)in section 37(1)(g) of that Act (which lists regulations under section 20 among the instruments under that Act which are subject to negative resolution),

there shall be substituted the words “, grass, bracken, gorse and vaccinium”.

2 Short title, citation and commencement.U.K.

(1)This Act may be cited as the Hill Farming Act 1985.

(2)This Act and the Hill Farming and Livestock Rearing Acts 1946 to 1959 may be cited together as the Hill Farming and Livestock Rearing Acts 1946 to 1985.

(3)This Act shall come into force at the end of the period of two months beginning with the day on which it is passed.
