On an appeal from any determination of a traffic commissioner under F1. . . the 1981 Act F2, the Goods Vehicles (Licensing of Operators) Act 1995 or this Act F3or under the Road Transport (Passenger Vehicles Cabotage) Regulations 1999, the tribunal shall have power—
a
to make such order as they think fit; or
b
to remit the matter to the traffic commissioner for rehearing and determination by him in any case where they consider it appropriate;
and any such order shall be binding on the traffic commissioner.

The tribunal may not on any such appeal take into consideration any circumstances which did not exist at the time of the determination which is the subject of the appeal.
