34 Matters to be taken into account by CAA.
(1)
This section applies to the following functions of the CAA, namely—
(a)
the function of giving advice to the Secretary of State on being consulted by him under any of sections 31 to 33, and
(b)
the function of preparing a scheme under section 33 where directed to do so under that section.
(2)
Section 4 of the 1982 Act (general objectives of the CAA) shall not apply to any function to which this section applies; and instead, in performing any such function, the CAA shall take into account—
(a)
such of the international obligations of the United Kingdom as the Secretary of State may notify to it for the purposes of this section; and
(b)
any advice received from the Secretary of State with respect to the relations of the United Kingdom with a country or territory outside the United Kingdom;
and, subject to that, shall have regard to the matters referred to in subsection (3).
(3)
Those matters are—
(a)
the need to secure the sound development of civil aviation throughout the United Kingdom;
(b)
the reasonable interests of users of air transport services; and
(c)
such policy considerations as the Secretary of State may notify to the CAA for the purposes of this section.
