Chapter IV Jurisdiction of Courts in Northern Ireland

19 Jurisdiction in cases other than divorce, etc.

A court in Northern Ireland shall not have jurisdiction to make a F1custody orderF1Part I order within section 1(1)(c) of this Act, other than one under Article 45(1) of the M1Matrimonial Causes (Northern Ireland) Order 1978, unless the condition in section 20 of this Act is satisfied.

The High Court in Northern Ireland shall have jurisdiction to make a F1custody orderF1Part I order within F2section 1(1)(d)F2section 1(1)(e) of this Act if, and only if,—

a

the condition in section 20 of this Act is satisfied, or

b

the ward is present in Northern Ireland on the relevant date (within the meaning of section 20(6) of this Act) and the court considers that the immediate exercise of its powers is necessary for his protection.
