F1The following paragraph shall be inserted after paragraph (a) of section 16(2) of that Act (defendant’s costs order)—

“(aa)

a notice of transfer is given under section 4 of the Criminal Justice Act 1987 but a person in relation to whose case it is given is not tried on a charge to which it relates; or”.
