SCHEDULE 4 S Tenancies which cannot be Assured Tenancies

Tenancies of agricultural holdings S

6 S A tenancy under which the house—

[F1 (a) is on or comprised in a lease constituting a 1991 Act tenancy within the meaning of the Agricultural Holdings (Scotland) Act 2003 (asp 11) or in a lease constituting a short limited duration tenancy or a limited duration tenancy (within the meaning of that Act); and]

(b) is occupied by the person responsible for the control (whether as tenant or as servant or agent of the tenant) of the farming of the [F2 and comprised in the lease].
