is on or comprised in a lease constituting a 1991 Act tenancy within the meaning of the Agricultural Holdings (Scotland) Act 2003 (asp 11) or in a lease constituting a short limited duration tenancy F2, a limited duration tenancy, a modern limited duration tenancy or a repairing tenancy (within the meaning of that Act); and

is occupied by the person responsible for the control (whether as tenant or as servant or agent of the tenant) of the farming of the F3and comprised in the lease.
