The Authority must carry out its functions under this Part in the manner that it considers is best calculated to implement, or to ensure compliance with, any binding decision of the Agency or the European Commission made under the Electricity Directive, the Electricity Regulation or the Agency Regulation F3(or the predecessor of the Electricity Regulation or the Agency Regulation) in relation to electricity.

For the purposes of subsection (1), a binding decision does not include a decision that is not, or so much of a decision as is not, retained EU law.
