3A child is not a privately fostered child while he is in the care of any person in compliance with—
(a)an order under [F1section 63(1) of the Powers of Criminal Courts (Sentencing) Act 2000]; or
(b)a supervision requirement within the meaning of [F2Part II of the Children (Scotland) Act 1995].
