Before deciding whether to make the recommendation the F6Secretary of State shall consider—

a

any representations made under paragraph 30 and the advice given by each of the designated judges; and

b

in a case where he is required to seek the advice of the Consultative Panel and the F5OFT, the advice given to him by the Consultative Panel and the F5OFTand of any representations made under paragraph 29.
