Prohibition on providing unlicensed local delivery services
82 Prohibition on providing local delivery services without a licence.

Any person who provides any local delivery service without being authorised to do so by or under a licence under this Part shall be guilty of an offence.

A person guilty of an offence under this section shall be liable—
a
on summary conviction, to a fine not exceeding the statutory maximum;
b
on conviction on indictment, to a fine.

No proceedings in respect of an offence under this section shall be instituted—
a
in England and Wales, except by or with the consent of the Director of Public Prosecutions;
b
in Northern Ireland, except by or with the consent of the Director of Public Prosecutions for Northern Ireland.

Without prejudice to subsection (2) above, compliance with this section shall be enforceable by civil proceedings by the Crown for an injunction or interdict or for any other appropriate relief.
