C2SCHEDULE 2 Registration of Old Mining Permissions

In this Schedule—
“official form” means, in relation to an application or appeal, a document supplied by or on behalf of the Secretary of State for use for the purpose in question, and
“owner” in relation to any land means any person who—
a
is the estate owner in respect of the fee simple, or
b
is entitled to a tenancy granted or extended for a term of years certain of which not less than seven years remain unexpired.

For the purposes of section 22 of this Act and this Schedule, an application under paragraph 1 or 2 above is finally determined when the following conditions are met—
a
the proceedings on the application, including any proceedings on or in consequence of an application under section 288 of the principal Act, have been determined, and
b
any time for appealing under paragraph 5 above, or applying or further applying under that section, (where there is a right to do so) has expired.
