54 Interpretation. E+W+S

[F1 (1)] In this Act—

• “[F2 non-resident parent]”, has the meaning given in section 3(2);

• [F5 “application for a [F6 variation]” means an application under section 28A [F7 or 28G];]

• “benefit Acts” means the [F9 Social Security Contributions and Benefits Act 1992 and the Social Security Administration Act 1992];

• [F10 “Commission” means the Child Maintenance and Enforcement Commission;]

• [F11 “default maintenance decision” has the meaning given in section 12;]

• [F10 “deposit-taker” means a person who, in the course of a business, may lawfully accept deposits in the United Kingdom;]

• “disability living allowance” has the same meaning as in the [F9 benefit Acts];

• [F14 “income-based jobseeker’s allowance” has the same meaning as in the Jobseekers Act 1995;]

• [F15 “income-related employment and support allowance” means an income-related allowance under Part 1 of the Welfare Reform Act 2007 (employment and support allowance);]

• “income support” has the same meaning as in the benefit Acts;

• “interim maintenance [F16 decision]” has the meaning given in section 12;

• “liability order” has the meaning given in section 33(2);

• “maintenance agreement” has the meaning given in section 9(1);

• [F17 “maintenance calculation” means a calculation of maintenance made under this Act and, except in prescribed circumstances, includes a default maintenance decision and an interim maintenance decision;]

• “maintenance order” has the meaning given in section 8(11);

• “parent”, in relation to any child, means any person who is in law the mother or father of the child;

• [F5 “parent with care” means a person who is, in relation to a child, both a parent and a person with care.]

• [F18 “parental responsibility”, in the application of this Act—

  (a)

  to England and Wales, has the same meaning as in the Children Act 1989; and

  (b)

  to Scotland, shall be construed as a reference to “parental responsibilities” within the meaning given by section 1(3) of the Children (Scotland) Act 1995;]

• “person with care” has the meaning given in section 3(3);

• “prescribed” means prescribed by regulations made by the Secretary of State;

• “qualifying child” has the meaning given in section 3(1);

• [F20 “voluntary payment” has the meaning given in section 28J.]

[F21 (2) The definition of “deposit-taker” in subsection (1) is to be read with—

(a) section 22 of the Financial Services and Markets Act 2000;

(b) any relevant order under that section; and

(c) Schedule 2 to that Act.]
