Water Industry Act 1991, Cross Heading: Application for variation of time for discharge is up to date with all changes known to be in force on or before 25 November 2024. Whole provisions yet to be inserted into this Act (including any effects on those provisions):
(1)If, after a direction has been given under any of the preceding provisions of this Chapter requiring that trade effluent shall not be discharged until a specified date, it appears to the sewerage undertaker in question that in consequence—
(a)of a failure to complete any works required in connection with the reception and disposal of the trade effluent; or
(b)of any other exceptional circumstances,
a later date ought to be substituted for the date so specified in the direction, the undertaker may apply to [F1the Authority] for such a substitution.
(2)[F1The Authority] shall have power, on an application under subsection (1) above, to vary the direction so as to extend the period during which the trade effluent may not be discharged until the date specified in the application or, if [F1it] thinks fit, any earlier date.
(3)Not less than one month before making an application under subsection (1) above a sewerage undertaker shall give notice of its intention to the owner and occupier of the trade premises from which the trade effluent is to be discharged.
(4)[F1The Authority], before varying a direction on an application under subsection (1) above, shall take into account any representations made to [F1the Authority] by the owner or occupier of the trade premises in question.
