5(1)Without prejudice to section 148 of this Act or to paragraph 11 of Schedule 6 to this Act or paragraph 1 above, where a person authorised by any relevant undertaker carries out any works by virtue of section 162 of this Act on any premises, the undertaker shall make good, or pay compensation for, any damage caused by that person or by any person accompanying him by or in connection with the carrying out of the works.E+W
(2)Any dispute between a relevant undertaker and any other person (including another such undertaker)—
(a)as to whether the undertaker should pay any compensation under this paragraph; or
(b)as to the amount of any such compensation,
shall be referred to the arbitration of a single arbitrator appointed by agreement between the undertaker and that person or, in default of agreement, by the Director.
