1 E+W Where by virtue of the provisions of Schedule 2 to the M1 Water Consolidation (Consequential Provisions) Act 1991 in relation to anything having effect under paragraph 21 of Schedule 26 to the M2 Water Act 1989 any matter falls to be determined by the Secretary of State in accordance with any of the provisions of Part III of this Act (other than section 91), that matter shall, if the Secretary of State refers the matter to the [F2 Agency] for determination, be determined by the [F2 Agency] instead.
