Duty of employer to notify Secretary of State

F1193A.F2Application of section 193 in certain cases involving redundancies of ships’ crew

(1)

Section 193 F3applies with the modifications set out in subsections (2) and (3) if—

(a)

the duty under section F4193(1) or 193(2) applies to a proposal to dismiss employees as redundant, and

(b)

F5some or all of the employees concerned are members of the crew of a seagoing F6ship which is registered at a port outside Great Britain.

(2)

The employer shall give the notification required by F7section 193(1) or (2) F7section 193(2) F8, so far as relating to the members of crew of a ship within subsection (1)(b), to the competent authority of the state where the F9ship is registered (F10as well as to the Secretary of State).

F11(3)

Where this subsection applies, section 193 is to be read as if references in subsections (4) and (6) to a notice were to the notice that is required to be given to the Secretary of State.

(4)

In this section “ship” includes—

(a)

any kind of vessel used in navigation, and

(b)

hovercraft.
