SCHEDULE 6 Retirement dates for certain judicial offices

Acting and deputy judges

(1)

In section 9 of the Supreme Court Act 1981, after subsection (1) (persons who may act as judges) there shall be inserted—

“(1A)

A person shall not act as a judge by virtue of subsection (1) after the day on which he attains the age of 75.”

(2)

After subsection (4) of that section (appointment of deputy High Court judges) there shall be inserted—

“(4A)

No appointment of a person as a deputy judge of the High Court shall be such as to extend beyond the day on which he attains the age of 70, but this subsection is subject to section 26(4) to (6) of the Judicial Pensions and Retirement Act 1993 (Lord Chancellor’s power to authorise continuance in office up to the age of 75).”

(3)

In subsection (6)(b) of that section (which refers to subsection (7) of that section, relating to the completion of proceedings after retirement), for the words “subject to subsection (7)” there shall be substituted the words “ subject to section 27 of the Judicial Pensions and Retirement Act 1993 ”.
