Before making regulations under this Chapter, the Secretary of State shall consult such persons as it appears to him to be appropriate to consult, having regard to the substance and effect of the regulations in question.

Without prejudice to the generality of subsection (1), the Secretary of State shall consult the F1Welsh Ministers and the Scottish Ministers before making regulations under this Chapter.
