The Secretary of State must issue, and may from time to time revise, guidance as to the matters which he will take into account in exercising his power under paragraph 10(1) or 11(3).

Before issuing or revising guidance under sub-paragraph (1), the Secretary of State must consult such persons as he considers appropriate.
