(1)[F1The Secretary of State] [F1DBS] shall issue a criminal record certificate to any individual who—
(a)makes an application under this section F2...,
[F3(aa)is aged 16 or over at the time of making the application,] and
(b)[F4pays any fee that is payable in relation to the application under regulations made by the Secretary of State.]
[F4pays in the prescribed manner any prescribed fee]
(2)An application under this section must be accompanied by a statement by [F5a Minister of the Crown] [F5a person mentioned in subsection (2A)] that the certificate is required for the purposes of an exempted question asked in the course of considering the applicant’s suitability for an appointment by or under the Crown.
[F6(2A)Any of the following persons may make a statement for the purposes of subsection (2)—
(a)a Minister of the Crown;
(b)a member of the Scottish Executive;
(c)any other office-holder in the Scottish Administration; or
(d)a nominee of any person mentioned in paragraphs (a) to (c).]
(3)[F7[F8Section 113A(3) to (6)]] [F7Sections 113A(3) to (6), 120AC and 120AD] shall apply in relation to this section with any necessary modifications.
