At the end of subsection (2) of section 104 of that Act (general provisions as to interpretation) there shall be inserted the words“if—

(a)

the sentences were passed on the same occasion; or

(b)

where they were passed on different occasions, the person has not been released under Part II of the M1Criminal Justice Act 1991 at any time during the period beginning with the first and ending with the last of those occasions.”
