1 Duty of Secretary of State to keep list.

The Secretary of State shall keep a list of individuals who are considered unsuitable to work with children.

An individual shall not be included in the list unless—
a
he has been referred to the Secretary of State under section 2 F1or 2Dbelow; or
F2aa
he has been included in the list under section 2B below;
b
he is transferred to the list from the Consultancy Service Index under section 3 below.

The Secretary of State may at any time remove an individual from the list if he is satisfied that the individual should not have been included in it.
