16(1)If section 36 of this Act comes into force before the repeal by this Act of section 83 of the [F1Senior Courts Act 1981], section 83 shall have effect until that repeal comes into force subject to the modifications specified in sub-paragraphs (2) and (3).U.K.

(2)Subsection (1) shall have effect as if for “may have rights of audience in the Crown Court” there were substituted “ shall be entitled to exercise their right of audience in the Crown Court even though they do not satisfy the regulations of the Law Society relating to the education and training which solicitors must receive in order to exercise their right of audience in the Crown Court ”.

(3)Subsection (3) shall have effect as if for “with” there were substituted “ who may exercise ”.

Textual Amendments

F1Sch. 14 para. 16: for the words "Supreme Court Act 1981" wherever they occur there is substituted (1.10.2009) the words "Senior Courts Act 1981" by virtue of Constitutional Reform Act 2005 (c. 4), ss. 59, 148, Sch. 11 para. 1(2); S.I. 2009/1604, art. 2
