Welfare Reform and Pensions Act 1999

2 (1) Sections 98 to 100 of the 1995 Act (gathering information: the Authority) shall apply as if any pension scheme which—

(a) is not an occupational pension scheme, but

(b) is or has been registered under section 2,

were an occupational pension scheme.

(2) Section 99 of the 1995 Act (as applied by sub-paragraph (1)) shall have effect as if the regulatory provisions, for the purposes of subsection (1) of that section, were—

(a) provisions made by or under the provisions specified in paragraph 1(2), other than section 110 of the 1995 Act;

(b) sections 111, 115 and 116 of that Act;

(c) any provisions in force in Northern Ireland corresponding to the provisions mentioned in paragraphs (a) and (b); and

(d) sections 1 and 2(4) to (6).

(3) Section 100 of the 1995 Act (as so applied) shall have effect as if the references in subsections (1)(c)(i) and (4)(b) to that Act included references to section 2(5).

(4) Any reference in this paragraph or paragraph 3 which is or includes a reference to, or to any subsection of, section 1 or 2 includes a reference to any provision in force in Northern Ireland corresponding to that section or (as the case may be) that subsection; and the reference in sub-paragraph (1) to any pension scheme includes a personal pension scheme (as well as an occupational scheme) within the meaning of the [1993 c. 49.] Pension Schemes (Northern Ireland) Act 1993.
