150(1)In this Schedule “utility” means an electricity utility or a gas utility.U.K.
(2)In this Schedule “electricity utility” means the holder of—
(a)a licence under section 6(1)(d) of the M1Electricity Act 1989 (supply licences), or
(b)a licence under Article 10(1)(c) or (2) of the M2Electricity Supply (Northern Ireland) Order 1992,
except where the holder is acting otherwise than for purposes connected with the carrying on of activities authorised by the licence.
Until the coming into force of the substitution for section 6 of the M3Electricity Act 1989 provided for by the Utilities Act 2000, paragraph (a) above shall have effect as if the reference to section 6(1)(d) were to section 6(1)(c) or (2).
(3)In this Schedule “gas utility” means the holder of—
(a)a licence under section 7A(1) of the M4Gas Act 1986 (supply licences), or
(b)a licence under Article 8(1)(c) of the M5Gas (Northern Ireland) Order 1996,
except where the holder is acting otherwise than for purposes connected with the carrying on of activities authorised by the licence.
(4)Sub-paragraphs (1) to (3) have effect subject to—
(a)any direction under paragraph 151(1), and
(b)any regulations under paragraph 151(2).
