F1SCHEDULE 19AReports of gifts received by unincorporated associations making political contributions

Offences

(1)

An unincorporated association commits an offence if it—

(a)

is required by paragraph 1 to give a notification to the Commission, or

(b)

is required by paragraph 2 to make a report to the Commission,

and fails without reasonable excuse to do so within the permitted period.

(2)

An unincorporated association commits an offence if, without reasonable excuse, it—

(a)

gives a notification to the Commission under paragraph 1, or

(b)

makes a report to the Commission under paragraph 2,

which fails to comply with any requirement of this Schedule applying to the notification or report.

(3)

An individual who knowingly or recklessly makes a false declaration under paragraph 4 commits an offence.

(4)

For the purposes of sub-paragraph (1) the “permitted period” is—

(a)

in relation to a notification under paragraph 1, the period of 30 days mentioned in paragraph 1(1);

(b)

in relation to a notice under sub-paragraph (2) of paragraph 2, the period of 60 days mentioned in that sub-paragraph;

(c)

in relation to a notice under sub-paragraph (3) of paragraph 2, the period of 30 days mentioned in that sub-paragraph;

(d)

in relation to a notice under sub-paragraph (4) of paragraph 2, the period of 30 days mentioned in that sub-paragraph.
