26 Meaning of “appropriate judicial officer” and “competent court”U.K.

[(1)]For the purposes of this Part—

  • appropriate judicial officer” means—

    (a)

    a District Judge (Magistrates’ Courts) designated for the purposes of this Act [F2by the Lord Chief Justice of England and Wales after consulting the Lord Chancellor] , or

    (c)

    the Sheriff of Lothian and Borders; and

  • competent court” means a court consisting of an appropriate judicial officer.

[F3(2)The Lord Chief Justice may nominate a judicial office holder (as defined in section 109(4) of the Constitutional Reform Act 2005) to exercise his functions under this section.]
