14In section 24(2) of the 1987 Act (grounds for appointment of manager), before paragraph (ac) insert—
“(abb)where the tribunal is satisfied—
(i)that there has been a failure to comply with a duty imposed by or by virtue of section 42 or 42A of this Act, and
(ii)that it is just and convenient to make the order in all the circumstances of the case;”.
