I2Consent to extradition

46I1Extradition order following consent

This section applies if a person consents to his extradition under section 45.

The judge must remand the person in custody or on bail.

If the judge has not fixed a date under section 8 on which the extradition hearing is to begin he is not required to do so.

If the extradition hearing has begun the judge is no longer required to proceed or continue proceeding under sections 10 to 25.

The judge must within the period of 10 days starting with the day on which consent is given order the person’s extradition to the category 1 territory.

Subsection (6) has effect subject to sections 48 and 51.

If subsection (6) is not complied with and the person applies to the judge to be discharged the judge must order his discharge.
