Justice (Northern Ireland) Act 2004

21 Statutory rules N.I.

(1) Any power to make an order or regulations under this Act is exercisable by statutory rule for the purposes of the Statutory Rules (Northern Ireland) Order 1979 (S.I. 1979/1573 (N.I. 12)).

(2) No order shall be made under section 8(5) unless a draft of the order has been laid before, and approved by a resolution of, [F1 the Northern Ireland Assembly].

[F2 (2A) Section 41(3) of the Interpretation Act (Northern Ireland) 1954 applies for the purposes of subsection (2) in relation to the laying of a draft as it applies in relation to the laying of a statutory document under an enactment.]

(3) An order under section 8(3)(c) or 11(4) and regulations under paragraph 1(4) [F3 , 5A(5)] or 6(1) of Schedule 3 shall be subject to [F4 negative resolution (within the meaning of section 41(6) of the Interpretation Act (Northern Ireland) 1954)].

(4) An order or regulations made under this Act may include supplementary, incidental, transitional or consequential provisions.
