A person is disqualified from being the Ombudsman or an acting Ombudsman if any of the following applies—

a

he is a member of the House of Commons;

b

he is a listed authority;

c

he is a member, co-opted member, officer or member of staff of a listed authority;

d

he is disqualified from being a member of the Assembly (other than by virtue of paragraph 6 of this Schedule or section 16(1)(d) of the Government of Wales Act 2006);

e

he is disqualified from being a member of a local authority in Wales (other than by virtue of paragraph 6 of this Schedule).

f

he is a care home provider, domiciliary care provider or independent palliative care provider;

g

he is an officer or member of staff of a provider of that kind.

For the purposes of sub-paragraph (1)(g) a person is an officer of a provider if he or she has control or management of a provider which is not an individual or the affairs of such a provider.

The appointment of a person as the Ombudsman or an acting Ombudsman is not valid if the person is disqualified under sub-paragraph (1).

If a person who has been appointed as the Ombudsman or an acting Ombudsman becomes disqualified under sub-paragraph (1), he ceases to hold office on becoming so disqualified.

But the validity of anything done by a person appointed as the Ombudsman or an acting Ombudsman is not affected by the fact that he is or becomes disqualified under sub-paragraph (1).

<num>1</num>
<intro>
<p>A person is disqualified from being the Ombudsman or an acting Ombudsman if any of the following applies—</p>
</intro>
<paragraph eId="schedule-1-paragraph-5-1-a">
<num>a</num>
<content>
<p>he is a member of the House of Commons;</p>
</content>
</paragraph>
<paragraph eId="schedule-1-paragraph-5-1-b">
<num>b</num>
<content>
<p>he is a listed authority;</p>
</content>
</paragraph>
<paragraph eId="schedule-1-paragraph-5-1-c">
<num>c</num>
<content>
<p>he is a member, co-opted member, officer or member of staff of a listed authority;</p>
</content>
</paragraph>
<paragraph eId="schedule-1-paragraph-5-1-d">
<num>d</num>
<content>
<p>
he is disqualified from being a member of the Assembly (other than by virtue of paragraph 6 of this Schedule or

<p>he is disqualified from being a member of a local authority in Wales (other than by virtue of paragraph 6 of this Schedule).</p>

<ins class="key-833988017de1731a82182e19142a1876-1522513180450 last">For the purposes of sub-paragraph (1)(g) a person is an officer of a provider if he or she has control or management of a provider which is not an individual or the affairs of such a provider.</ins>
</p>

<subparagraph eId="schedule-1-paragraph-5-2">
<num>2</num>
<content>
<p>The appointment of a person as the Ombudsman or an acting Ombudsman is not valid if the person is disqualified under sub-paragraph (1).</p>
</content>
</subparagraph>
<subparagraph eId="schedule-1-paragraph-5-3">
<num>3</num>
<content>
<p>If a person who has been appointed as the Ombudsman or an acting Ombudsman becomes disqualified under sub-paragraph (1), he ceases to hold office on becoming so disqualified.</p>

</subparagraph>
<subparagraph eId="schedule-1-paragraph-5-4">
<num>4</num>
<content>
<p>But the validity of anything done by a person appointed as the Ombudsman or an acting Ombudsman is not affected by the fact that he is or becomes disqualified under sub-paragraph (1).</p>
