(1)

Amend section 28G (statutory undertakers, etc.: general duty) as follows.

(2)

In subsection (3)(e), omit “(meaning the persons referred to in section 262(1), (3) and (6) of the Town and Country Planning Act 1990)”.

After subsection (3) insert—

“(4)

“Statutory undertaker” means a person who is or is deemed to be a statutory undertaker for the purposes of any provision of Part 11 of the Town and Country Planning Act 1990.”
