Services to which this section applies are to be treated as services of the Crown for the purposes of—

Schedule 1 to the Registered Designs Act 1949 (provisions as to the use of registered designs for the services of the Crown etc.), and

b

sections 55 to 59 of the Patents Act 1977 (use of patented inventions for the services of the Crown).

This section applies to services provided in pursuance of—

    and includes clinics, dispensaries and out-patient departments maintained in connection with any such home or institution, and “hospital accommodation” must be construed accordingly,

  • illness” includes F4any disorder or disability of the mind and any injury or disability requiring medical or dental treatment or nursing,

  • local authority” means a county council, a county borough council, a district council, a London borough council, and the Common Council of the City of London,

  • medicine” includes such chemical re-agents as are included in a list approved by the Secretary of State for the purposes of section 126,

  • modifications” includes additions, omissions and amendments,

Subject to this section, this Act comes into force on 1st March 2007.

In this section—

  • the 1977 Act” means the National Health Service Act 1977 (c. 49), and

  • the 2006 Act” means the Health Act 2006 (c. 28).

To the extent that—

this Act re-enacts a provision to which this subsection applies, and

the provision has not come into force before the commencement of this Act,

the re-enactment by this Act of the provision does not come into force until the provision which is re-enacted comes into force; and the re-enactment comes into force immediately after, and to the extent that, the provision which is re-enacted comes into force.

Accordingly, the re-enactment by this Act of the provision does not affect any power to bring the provision into force.

278Short title, extent and application

This Act may be cited as the National Health Service Act 2006.

Subject to this section, this Act extends to England and Wales only.

Sections F63260 to 266 in Part 13 (price of medical supplies) F64, and this Part to the extent that it applies to those sections, extend also to Scotland and Northern Ireland.

The Secretary of State may by order provide that this Act, in its application to the Isles of Scilly, has effect with such modifications as may be specified in the order.
