Guidance E+W

215 Use of intervention powers E+W

(1) The regulator shall publish—

(a) guidance about [F1 the submission of information] to the regulator about the performance of registered providers, and

(b) guidance about how it uses and intends to use powers under this Chapter and Chapter 7.

(2) Guidance under subsection (1)(a) must, in particular, specify [F2 how the regulator will deal with the submissions it receives.]

[F3 (2A) Guidance under subsection (1)(b) must, in particular, specify how the regulator applies and intends to apply the tests in section 198A (use of certain powers in cases of failure or potential failure to comply with standards under section 193).]

(3) The regulator shall have regard to guidance under this section.

Before giving guidance under section 215 the regulator must consult—

(a) one or more bodies appearing to it to represent the interests of registered providers,
