110Inspections under this Chapter: power of entry etc
(1)
This section applies to any inspection of a registered independent educational institution that is carried out by the Chief Inspector under this Chapter.
(2)
The Chief Inspector has at all reasonable times—
(a)
a right of entry to the premises of the institution for the purposes of the inspection, and
(b)
a right to inspect and take copies of any records kept by the institution and any other documents containing information relating to the institution that are required for the purposes of the inspection.
(3)
Section 58 of the Education Act 2005 (c. 18) (computer records) applies in relation to the inspection of records or other documents under subsection (2)(b).
(4)
This section does not confer power to inspect or take copies of anything of a kind specified in section 9(2) of the Police and Criminal Evidence Act 1984 (c. 60) (legally privileged material etc).
(5)
It is an offence intentionally to obstruct a person in the exercise of the person's functions in relation to the inspection.
(6)
A person guilty of an offence under subsection (5) is liable on summary conviction to a fine not exceeding level 4 on the standard scale.
